The Context
The Government of Vietnam’s (GoV) National Assembly (NA) Council is undertaking revisions to Vietnam’s 2013 land law and land reform process affecting ethnic minorities throughout the country.
The TAP-EDM Technical Assistance Initiative (TAI) will recruit and deploy Canadian and Vietnamese subject matter/technical experts to support a participatory, evidence-based, systems-approach review/assessment of the existing land reform law and inform the drafting of a revised law. The primary objective is to review the impact of land reform processes on ethnic minorities and to ensure their continued relevance and appropriateness to Vietnam’s policies and respect for ethnic minorities who have been impacted by relocation and continued development of traditional forest lands. With TAP-EDM’s support, the new law shall also consider the needs of women and other marginalized groups, the environment/climate, and the fundamental principles of ethnic minority rights. The initiative will also support/facilitate outreach and engagement with ethnic minorities as part of this review/revision process.
The Role The activities planned within this initiative focus on strengthening the National Assembly (NA)’s regulatory capacity in the land sector, particularly in the areas that face implementation challenges such as gender inequality, environment, climate change, and ethnic minorities (EM) issues in order to capacitate members in developing the 2023 Land Law.
